Our Real Estate Litigation team and building safety experts have successfully obtained a remediation order for Vista Tower, Stevenage. We acted on behalf of the Secretary of State for the Department of Levelling Up, Housing & Communities (DLUHC), contributing to the government’s ongoing efforts to ensure building safety standards are upheld.
The Vista Tower case marks as a significant development in understanding the approach that Tribunals will take to the question of when a remediation order will be made. The remediation order, granted by the First-tier Tribunal, requires the relevant landlord to remedy defects in the building within a specified timeframe. Despite the landlord having entered into a works contract by the date of the final hearing, the Tribunal still granted a remediation order. The Tribunal’s view is that the focus of the BSA is on leaseholder protection and it was important to provide leaseholders with the reassurance as to a backstop as to when the remedial work would be completed by.
