In civil litigation in England and Wales, each party must formally disclose to the other documents which are relevant to the issues in dispute. The Disclosure and Inspection process enables the parties to learn more about each other’s case and it ensures that parties have access to the same information when preparing for trial.
From a practical point of view, however, the Disclosure process can be a very onerous process for clients. There may be a great many documents to search through to identify those which must be disclosed.
